COPYRIGHT

Copyright law offers comprehensive protection for almost all forms of creative work.

In times of digitalisation and the Internet, copyright law is constantly changing. Digital content is often copied and reproduced without being licensed. With our decades of expertise and experience in copyright and art law, we represent diverse interests of authors/artists, companies and rights holders in all sectors with precision and success.

Learn more
Copyright law serves to protect individual intellectual creations. In Europe, a copyright is established with the manifestation of a work. It does not require application or registration and remains in force for up to 70 years after the death of the author. The provisions of copyright law grants authors exclusive rights to use and exploit their work, e.g. in the form of publication, distribution, reproduction or other utilisation of the work. Of course, these exploitation rights can also be transferred to third parties.

Despite comprehensive copyright protection, copies, imitations and other uses of protected works frequently occur in practice. Effective copyright protection therefore also requires consistent legal enforcement. In these and other cases, we are there for you and provide you with advice and assistance in enforcing your rights in- and outside of court. Drafting, revision and negotiation of contracts in a wide range of industries are also part of our core competencies – so that your creative works are recognised and appropriately remunerated. Of course, we are also on your side when defending against often unjustified or excessive copyright warnings and lawsuits. In doing so, we regularly work together with copyright collecting societies and organisations that represent the interests of authors, rights holders and designers.

Our copyright experience extends to numerous areas and sectors:

TRADEMARK LAW

Your trademark is an indication of origin for your company's goods and services, but also your distinguishing feature, your corporate identity and your seal of quality.

Trademarks significantly and directly contribute to a company’s economic success. This more important it is to optimally protect and position your trademark(s). That starts with the registration of your trademark in a national, European or international trademark register, but does not end there.

Learn more
To enable customers and consumers to distinguish your company's goods and services from those of others, you need a means of identification – your name, your label, your trademark. Optimal prevention of use of identical or confusingly similar terms and logos by other companies, however, requires registering your trademark and thus obtaining trademark protection. This way, you preserve the identity of your company and the uniqueness of your products or services, even in a highly competitive market environment.

Obtaining trademark protection requires registration in a trademark register – e.g. nationally, in the EU or internationally. We are experts in checking whether registration of your mark is possible and for which type of products and services your trademark can and should be registered. We provide you with individual advice from your initial idea to your registered trademark.

But your trademark will become a unique selling point primarily through ongoing monitoring. This is why we carry out regular research for identical and similar trademarks and designations, undertake the assessment of a possible infringement case under trademark law and, if necessary, enforce your trademark claims.

In trademark law, we also impress with our ‘all-round carefree packages’, which include our range of services according to your individual needs and wishes.

DESIGN LAW

Design is more than just external form, it embodies the identity of a product and has a significant influence on consumer perception.

Design law protects the appearance of products against imitations. This means that aesthetic and design elements of products can be protected by registering a design. Protection can be obtained nationally in individual countries or internationally (especially EU-wide) at relatively low cost. Whether interiors, electronic devices, toys, chocolates or vehicles – you name it, we protect it.

Learn more
The process of designing a new product can be lengthy and cost-intensive – making it all the more important to optimise the protection of your unique design. In addition to products and articles, design rights are also suitable for protecting designs, shapes and packaging.

By registering a design, you can prohibit third parties, especially commercial manufacturers and suppliers, from using your design creation.

If you are looking for professional advice and legal protection for your design innovations, we are your experienced and competent partner. For many years, we have stood by the side of designers and organisations that represent the interests of designers and have stood up for their interests right up to the European legislative level.

BUSINESS LAW

COMPETITION LAW

Every entrepreneur must abide by the ‘rules of the game’ of fair competition – towards consumers, but also towards their competitors.

Unfair, misleading or aggressive business practices, e.g. in the form of comparative advertising or imitation of products and other creations, can lead to disruptions in the functioning of the market and can give your competitors an unjustified advantage. Ask us – we represent you in competition law and enforce your claims in a targeted manner.

Learn more
Competition helps consumers to defend themselves against unfair business practices, but it also offers entrepreneurs the opportunity to take action against disparagement, breach of law and obstruction by their competitors. Also, the imitation of a competitors' product or creation can have consequences under competition law – even if other property rights (such as copyright, trade mark law, etc.) do not apply.

Unfair business practices unfortunately occur again and again in an economic market, but you do not have to accept them. We are happy to assist you in enforcing your claims.

With our experience, we support you with a wide range of services in the field of unfair competition law:

  • Competition law audits, assessments and evaluations of the market behaviour of competitors (business practices, public relations, etc.)
  • Competition law audits, assessments and support in relation to:
    • advertising measures, both online and offline (advertising campaigns, comparative advertising, etc.)
    • e-commerce: websites, online shops, newsletters, e-commerce , platforms, etc.
  • Competition law support when launching products, opening distribution channels or licencing
  • Written warnings in cases of unfair, anti-competitive behaviour
  • Defence against warnings, lawsuits and interim injunctions by competitors

DATA PROTECTION LAW

Almost every company, no matter how small, processes personal data of business partners and customers. This data deserves careful handling and protection.

Processing personal data is subject to complex legal regulations – not just since the infamous GDPR came into force. We support companies of all kinds in developing data protection measures that are customised to their activities and size. From data protection declarations in contracts or on websites to customised and sustainable compliance measures.

Finally, it is important to respond correctly and promptly in the event of a data protection enquiry from a customer. As lawyers with specialised training in data protection law, we can help you make and keep your company fit for data protection.

In addition, we advise and represent you in the many different types of proceedings in Germany and Austria - be it in claims for damages, in proceedings before data protection authorities, but also in fine and civil proceedings due to possible data protection violations.
